HOW TO ENTER

The competition commences on Monday, August 8, 2011 and concludes on Monday, August 15, 2011 at 5pm (“the Competition Period”).

In order to enter the competition entrants must have purchased tickets to The Falls Music & Arts Festival in Lorne or Marion Bay through the ballot and have their purchase confirmation code. Each 14 digit ID confirmation code can only be used to enter the competition once. To be eligible, entrants must answer the question in 25 words or less: What are you looking forward to the most about The Falls Music and Arts Festival this year? on the official facebook page of the festival.
This competition is a game of skill. The judge’s decision in relation to all aspects of the competition is final. No correspondence will be entered into.

Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 years before entering the competition. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.

The prize winner will be notified by email by Friday 19th August, 2011

PRIZE

There is one prize being offered which consists of a $3,000 AirAsia flight voucher. The winner can choose between any flights on an AirAsia route, subject to availability. Route to Asian destinations are more available than those to Europe. Any flight costs beyond the $3,000 flight voucher are to be paid by the prize winner. TOTAL PRIZE POOL VALUE $3,000 (inc. gst).

All flights must be taken prior to 19th August 2012 (outgoing and return flights must be completed within this period).

The prize is non-refundable, non-transferable and not exchangeable for cash or any other benefits in kind. For the avoidance of doubt, the prize winner may apply the prize to multiple flights of the prize winner and may apply part of the prize to travel companion flights.

AirAsia must receive a minimum of 2 weeks’ booking notice.

AirAsia X will not entertain any request to extend the validity period.

The prize DOES NOT include all relevant airport taxes and fees.

The prize is subject to AirAsia X Terms and Conditions of Carriage.

The terms and conditions of any third party will apply to the prize where applicable.

The prize includes AirAsia flights only. For the avoidance of doubt, the prize winner will be responsible for the cost of all other expenses, including but not limited to: travel insurance, passports, visas, meals, baggage allowance, taxes not included in the price of the ticket, ground transportation, any flights with other airlines including connecting flights, or any other costs of a personal nature not stated here as included in the prize. Compliance with any health or other government requirements is the responsibility of the/each prize-winner and companion.

Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

There can be no changes (name of traveller, travel date, etc) made to travel arrangements once bookings are made.

AirAsia X and the competition Promoter accept no responsibility for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by the winner or their guest(s) in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

To the full extent permitted by Law, the Competition Entrant and Prize Winner indemnifies the competition Promoter & AirAsia against all present and future legal liability, claims, or proceedings for:
(a) personal injury to, or death to the Prize Winner, a Competition Entrant or a third party;
(b) either or both loss of, or damage to, property of the Prize Winner, a Competition Entrant or a third party; and
(c) financial loss of the Prize Winner, a Competition Entrant or a third party;
sustained or arising, whether directly or indirectly, as a consequence of the a Competition Entrant’s participation in the Competition; or arising or attributable to the Prize Winner taking any component of the Competition Prize.

ii) The indemnities in clause 2.13):
(a) are continuing obligations of the Competition Entrant or Prize Winner, separate and independent from any other obligations; and
(b) survive the termination of this Agreement.

AirAsia X retains the right to substitute the prize with another of similar value in the event the original prize offered is not available due to circumstances beyond its reasonable control.

All bookings must be made directly to AirAsia X via the contact person provided. Bookings cannot be made via a third party.

By making a booking, the winner and guest(s) are deemed to have agreed to the terms and conditions of this prize as well as AirAsia X’s terms and conditions of carriage available at airasia.com.

AirAsia X reserves the right to amend the terms and conditions listed at any time without prior notice.

If for any reason the winner does not take the prize or any element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash and will be forfeited. The prize is not transferable or redeemable for cash equivalent.

All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, each entrant is granting the competition Promoter permission to use their entry for any The Falls Music and Arts Festival marketing materials. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media as required under the relevant lottery legislation and as set out above.  A copy of The Falls Music & Arts Festival Privacy Policy may be found at www.fallsfestival.com.
